Welcome to Tha Homemade (“Tha Homemade,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, online shop, social channels (including Instagram and LINE), and our physical store (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

This page is intended to be clear and customer-friendly. Nothing here limits any statutory rights you may have under applicable consumer laws.


1) Who we are & how to contact us

Tha Homemade is a small, family-run brand based in San Pa Tong, Chiang Mai, Thailand.

2) Eligibility & your account

  • You must be at least 18 (or the age of majority in your jurisdiction) to place an order. If under 18, a parent/guardian must consent and complete the purchase.

  • If you create an account, you are responsible for keeping your login details secure and for all activities under your account.


3) Product information & handmade variation

  • Our pieces are handmade. Patterns and colors will vary from photos; slight differences are part of each item’s uniqueness.

  • Natural dye / eco-printing may show subtle color movement/fading over time; batik pieces include care instructions in the package.

  • We try to display colors accurately, but screen settings and lighting may cause differences.


4) Orders, pre-orders & acceptance

  • Most items are made to order. Standard production takes 10–15 days after purchase (see Shipping & Returns for delivery estimates).

  • Your order is an offer to buy. We may accept or decline at our discretion (e.g., stock limits, suspected fraud). If declined, we will refund you.

  • We may limit quantities on select releases (e.g., 1 item per customer).

Bot Policy (fair releases): Orders placed via bots, scripts, automated services, or unauthorized checkout links may be canceled and refunded. Please access new releases from our homepage. See also FAQ.


5) Pricing, taxes & duties

  • Prices are shown in the currency indicated at checkout and may change without notice.

  • For international orders, your parcel may incur import duties and taxes at the destination. These charges are your responsibility. We cannot control or estimate them; please check your local customs website before ordering.


6) Payments

We accept Visa, MasterCard, PayPal, PromptPay, and Thai Internet Banking via our payment partners.

  • Payment is processed at checkout. We do not store full card details.

  • If a payment is flagged for review, we may contact you or cancel and refund.


7) Shipping, delivery & risk of loss

  • After production (10–15 days), typical delivery times are:

    • Thailand: 1–5 business days, ฿50

    • Asia: 5–7 business days (flat), US$30

    • Worldwide: 5–7 business days (flat), US$50
      International orders ship via various carriers depending on the country. Delivery times are estimates and may vary due to customs, weather, holidays, or local courier issues.

  • Tracking is provided when available.

  • Risk of loss passes to you upon delivery to the address you provided (or upon pickup/collection by you).


8) Returns & exchanges

  • Thailand orders: We gladly accept exchanges if the item is unworn, unwashed, undamaged, in original condition (including tags/packaging), and you contact us within 5 days of delivery. You are responsible for return shipping; we’ll ship the exchange after inspection and stock confirmation. For defects or incorrect items, contact us within 48 hours of delivery.

  • International orders: No returns, refunds, or exchanges (final sale), except where required by local law.

9) Promotions, discounts & membership

  • From time to time, we offer promotions (e.g., 10% OFF for new website members: first item only). Unless stated otherwise:

    • Valid once per new account/household, non-transferable, not combinable with other offers.

    • Not valid on past orders, gift cards, shipping, duties, or taxes.

    • Misuse, duplication, or suspicious activity may result in order cancellation.

  • We may modify or end promotions at any time.


10) Acceptable use

You agree not to:

  • Use bots or automated tools to purchase or access the shop.

  • Interfere with or disrupt the Services, or attempt to bypass security measures.

  • Use the Services for unlawful purposes or to infringe any rights.


11) Intellectual property

All content on the Services, including product photos, designs, text, graphics, and logos, is owned by or licensed to Tha Homemade and protected by applicable laws. You may not copy, distribute, or create derivative works without our written permission.

User content & reviews: If you tag us or share photos/reviews, you grant us a non-exclusive, royalty-free license to display and share that content on our channels only with your permission (we’ll ask before reposting).


12) Third-party services & links

We use third-party providers (payments, shipping, hosting, analytics). Their services are subject to their own terms and privacy policies. We are not responsible for third-party sites or services.


13) Privacy

Your privacy matters to us. Please read our Privacy Policy to understand how we collect, use, and protect your information.


14) Warranty disclaimer

Our items are handmade and provided on an “as is” basis, with all their natural variations. To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not affect any non-waivable consumer rights you may have.


15) Limitation of liability

To the extent permitted by law, Tha Homemade will not be liable for any indirect, incidental, special, or consequential damages, loss of profits, or data arising from your use of the Services or purchase of products. Our total liability for any claim will not exceed the amount you paid for the product related to that claim. This section does not limit liability that cannot be limited under applicable law.


16) Indemnification

You agree to indemnify and hold Tha Homemade and our team harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or infringement of any rights.


17) Force majeure

We are not responsible for delays or failure to perform due to events beyond our reasonable control (e.g., natural disasters, strikes, war, pandemics, governmental actions, power or internet failures).


18) Changes to the Services or Terms

We may update these Terms or the Services at any time. Changes are effective when posted with the “Last updated” date above. If changes are material, we’ll aim to notify you via our site or channels. Continued use of the Services after changes means you accept the new Terms.


19) Governing law & dispute resolution

These Terms are governed by the laws of Thailand, without regard to conflict-of-law rules.

  • We encourage you to contact us first to resolve any issues.

  • If we cannot resolve disputes informally, disputes may be brought in the courts of Thailand with appropriate jurisdiction.

  • Consumers may have additional rights to bring claims in small-claims forums where available.


20) Severability & waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver of our right to enforce it later.


21) Language

We may provide these Terms in Thai and English. If there is any inconsistency, the Thai version may govern for Thailand operations; otherwise, the English version governs.
